Our Property and Development team has extensive experience across all aspects of property and development law including major projects, joint ventures, project management, commercial leasing, planning, environment, heritage and local government issues and compulsory land acquisitions. Russell Kennedy’s Property team is one of the largest in Victoria. Four property team members are Law Institute of Victoria (LIV) Accredited Specialists in property related areas, Property Law and in Commercial Tenancy Law.

Russell Kennedy also has LIV accredited specialists in the areas of Wills & Estates, Environment & Planning and Local Government Law. Seven property members have been recognised by Best lawyers in the categories of Retirement Villages & Senior Living Law, Real Property Law and Commercial Law.

Leasing

We act Australia-wide for landlords and tenants in the public and private sector covering all aspects of leasing and licensing.

Our service offering includes:

  • preparing and negotiating agreements for lease and lease documents for major leasing transactions and specialty tenancies
  • preparing commercial and retail offers to lease and disclosure statements
  • negotiating complex leasing transactions
  • specialty advice on existing lease terms including rent review issues, maintenance obligations, make good obligations and outgoing recoveries
  • advice as to compliance with various retail leasing legislation
  • assisting clients to resolve leasing disputes.

Our leasing experience includes:

Acting for clients in relation to real estate investments in Victoria and New South Wates, which includes high volume leasing transactions in CBD buildings, including retail premises, complex industrial, commercial and retail leasing matters and tenancy dispute matters.

Advising clients in relation to multiple agreements for lease and lease for construction of purpose built retail, office and community use centres. Including preparation of tenant standard form agreements for lease and advice regarding landlord standard documentation and negotiation of tenants preferred terms. We have acted for clients on agreement for lease and lease transactions in all Australian jurisdictions.

Russell Kennedy is a leader in the provision of legal services to the property and development sector; in particular, for clients with large and diverse landholdings. We understand the industry and have specific expertise in CBD and significant commercial properties, residential built-form, apartment and townhouse developments, in addition to land, industrial and commercial sites.

Our clients include large and boutique property developers, land owners, government entities and commercial building owners.

The experience of our team includes: complex subdivisions, including advising on owners corporation issues, structuring advice, preparing sales documentation and acting in all aspects of the subdivision process and high volume conveyancing.


Sales and Acquisitions

Our property and development team has extensive experience advising private and public clients on the sale and acquisition of major commercial and residential buildings, shopping centres and industrial sites, as well as the sale and acquisition of Crown Land.

We represent property developers, private landowners and investors, government departments and local councils on their sale and purchase transactions including preparing and advising on contracts of sale and statutory disclosures, undertaking purchaser due diligence and negotiating contract terms.
