The article discusses the Privacy Amendment (Notifiable Data Breaches) Act 2017 received Royal Assent on 22 February 2017.

  • The Act amends the Privacy Act 1988 and introduces mandatory data beach notification requirements for entities subject to the Privacy Act;
  • The new notification requirements have not yet commenced and will start no later than 23 February 2018.

The new requirements will require agencies, organisations and certain other entities to provide notice to the Australian Information Commissioner and affected individuals of certain data breaches.  For example a cyber intrusion involving the publication online of individuals’ names and credit card numbers; or the accidental publication of patient records by a medical practice.
