This webinar is relevant to people working in State Government, Local Government, Water Corporations and from Waste & Resource Recovery organisations. This session will be useful to procurement professionals, project managers and facilities owners and operators in the waste and resource recovery sector. 

Principals, Stefan Fiedler and Kyle Gillan will discuss the impact of the introduction of the new Environment Protection Act 2017 and Regulations on waste and resource recovery projects and contracting. They will discuss the impact of the new legislation on commercial contracting across the full logistics chain from transport contracts, to facilities management contracts, and new major infrastructure projects.

This webinar will cover:

  • The new General Environmental Duty under the Environment Protection Act 2017
  • How to discharge the General Environmental Duty through your organisation’s contracting and procurement activities
  • The impact of the new General Environmental Duty on waste and resource recovery contracts, including collections, transport, disposal and infrastructure construction and management

Kyle is a construction and major projects lawyer with experience acting for councils and other government agencies, owners and contractors in relation to procurement of waste and resource recovery services and infrastructure. He understands the unique legislative and policy context for the waste and resource recovery sector.

Kyle advises on a range of procurement methods, including collaborative procurements for local government and regional waste management groups, long term service agreements, as well as infrastructure procurement methods such as construct only, design and construct (D&C), relationship contracting (collaborative contracting, managing contractor and alliances), public private partnerships/project finance, and facilities operation and maintenance. Kyle advises on standard form contracts, including Australian Standards, including for local government.

Stefan Fiedler

Principal

Stefan bring 20 years’ industry experience within State Government (7yrs industry approvals and regulation) and private sector (13yrs legal) to his advocacy for Local Government. He is a leading environmental lawyer who acts for local government, water corporations, waste and resource recovery groups and corporations across various sectors including waste management, resource recovery, infrastructure, manufacturing, organics, rendering, logistics and agriculture.

His practice involves landfills, solid waste management, contaminated land and groundwater, EPA licensing and approvals, trade waste, reclaimed water, stormwater drainage and enforcement. Prior to practicing law, Stefan worked as an environmental engineer for the Environment Protection Authority.

Michael practises in the areas of procurement, construction and infrastructure with his primary focus on contractual work. In his procurement work, he assists clients in drafting and interpreting contracts for the provision of goods and services, with a strong focus in waste and resource recovery sector. In this sector, Michael has significant experience assisting Victorian councils in drafting their waste and resource recovery contracts and advising in contractual negotiations.

In the construction and infrastructure space Michael focuses on “front end” contractual drafting. He is experienced in assisting with drafting construction contracts and related documents including Australian Standards. Michael also has experience in dispute resolution and has assisted construction companies and consultants in both small and large-scale disputes including Supreme Court matters, adjudications and commercial arbitrations. He is also a member of Society of Construction Law Australia.
